NEW BRUNSWICK: Another restaurant closed; others get red-stripe status

Another Fredericton-area food establishment has had its licence revoked, while two others have been hit with red-striped warnings, indicating they've failed in major areas of the government's inspection report.
The Golden Mile Roadhouse on Route 101 in New Maryland failed its inspection Thursday, and its licence was yanked by the provincial Health Department.
Chez Riz on Queen Street was closed Tuesday after a health inspector wrote up three pages of violations on everything from food-handling practices to cleanliness of the premises and restaurant equipment.
The restaurant reopened Friday.
Health Department spokeswoman Meghan Cumby said for a restaurant to regain its licence, it has to meet the green standard - the highest score available to a food service establishment –- upon reinspection.
The province has a colour-based scoring system.
Yellow indicates a restaurant has a mix of minor and major problems. A striped-red warning signals major or critical failings, while a solid-red signals a licence has been revoked.
"I've called my maintenance man right away. After 10 years of working day and night, I guess I neglected the basic cleanups. It won't happen again," said Golden Mile owner Mon Hong. "It's going to take at least three days to do a lot of repairs."
He said he hopes to have his reinspection done at the first of next week.
The health inspector cited the Golden Mile Roadhouse for, among other things, fridge cleaning issues, improper storage of dry noodles and failure to keep cooked chicken balls at the property temperature until served.
"Staff unaware of proper temperature holding of potentially dangerous foods," the inspector wrote of one violation marked critical.
"No handwashing observed during inspection" was another major violation.
The restaurant was cited for not cleaning the walk-in cooler, fridge racks and defrosting.
The inspector said a health policy has to be posted for staff, along with handwashing rules.
Food in a walk-in cooler wasn't stored at the proper temperature and all food had to be discarded, said another section of the five-page report.

The Michelin-starred restaurant, run by renowned chef Heston Blumenthal, had to shut its doors earlier this month after 40 diners complained of feeling unwell after eating at the Fat Duck.
While it was closed a further 400 people came forward, claiming they too had been hit by a mysterious bug from the restaurant. This figure has now climbed to 529, including celebrities such as boxing promoter Frank Warren.
On Friday the Health Protection Agency said that it was still conducting its investigation, but confirmed that six members of staff and eight diners had been infected with norovirus – known as the "winter vomiting disease" and the most common cause of stomach bugs.
A spokesman denied the restaurant had been negligent in allowing sick staff to work at the Fat Duck.
"We are pleased that the HPA has identified a potential source as its tests have shown that some staff and customers carried the norovirus. While the source of this virus is nearly impossible to identify, if a member of staff returned to work whilst still carrying it then they did so unaware they either had the virus or were still contagious.
"We will continue to work with the HPA and their ongoing investigation."
Blumenthal is understood to have lost about £300,000 while the restaurant, famed for its snail porridge and bacon & egg ice cream, was closed.

FREDERICTON -- A Fredericton restaurant has had its licence revoked after an inspection Tuesday found three pages worth of items needing correction.
Chez Riz, which opened in July 2005, serves Indian and Pakistani cuisine at its Queen Street location.
Rizwan Ul-Haq was working at the restaurant yesterday evening, trying to correct the deficiencies identified in his March 17 inspection.
He's promising to keep a closer eye on the establishment and he's hoping inspectors will give him a clean report today after a re-inspection.
"I will be ready today or tomorrow. He'll (the inspector) check everything and we'll be fine," Ul-Haq said. "I will give more attention to this, because I've never had any problem. I was always on green until the day before yesterday. They've checked a couple of times and everything was fine."
A green colour code, according to the government's restaurant inspection website, means an establishment has only a couple of minor problems. It's the government's top rating for a restaurant.
Ul-Haq said one of his problems is that the restaurant's building was recently flooded due to a leaking roof and melting snow.
The inspection report said the walk-in refrigerator needed cleaning and knives under a steam table were dirty. A large can opener was dirty.

TENNESSEE: Restaurant-goers sickened by raw oysters, again

CHATTANOOGA, Tenn. -- Just about two months after a previous outbreak, more illnesses have been reported by people who ate raw oysters at the Boathouse Rotisserie and Raw Bar. The Chattanooga-Hamilton County Health Department recommends that consumers avoid raw oyster consumption.
Nineteen people reported illnesses after eating at the Boathouse between January 12th and 18th. Recent illnesses associated with raw oyster consumption included 9 ill individuals who ate there between March 5th and March 8th.
Following an inspection at the restaurant, health officials did not identify the facility as a source of the infection.
Following standard protocol, the Health Department conducted the investigation to determine the cause of the illness. Persons reporting illness have been contacted and interviewed. Laboratory testing of ill individuals identified Norovirus as the cause of the illness. The establishment fully cooperated with the Health Department's procedures, including halting service of implicated oysters when notified of the illnesses.
Bacterial and viral pathogens can be carried in oysters, including Vibrio, Hepatitis A and Norovirus. Even in healthy individuals, these pathogens cause illness. These illnesses can be severe, particularly in the elderly or in persons with weakened immune systems. In addition, most of these illnesses can then be spread to other individuals through person to person contact.
"Oysters should be cooked thoroughly," says Margaret Zylstra, Epidemiology Manager at the Chattanooga-Hamilton County Health Department. "Any oyster not thoroughly cooked poses the risk of foodborne illness."

MOUNDSVILLE, W.Va. -- Charges are pending against two fast-food restaurant employees after a sheriff's deputy said he found pubic hair on his sandwich.
According to the Marshall County Sheriff's Department, the deputy went through the Wendy's drive-through in Moundsville Sunday night before heading to work.
He finished his chili and opened his sandwich. It was then he said he spotted the ball of pubic hair.
Later, Wendy's employees Thomas Bender and Joshua Monroe confessed to the crime and said they purposely targeted an officer, Chief Deputy Kevin Cecil said.
Cecil said 32-year-old Bender admitted to putting the hair on the food, and 20-year-old Monroe admitted he encouraged Bender to do it.
A charge of tampering with food is pending for Bender. Monroe could be charged with aiding and abetting or conspiracy, police said.
Deputies are waiting for Bender's blood test results. If he has any diseases, the misdemeanor charge will be escalated to a felony.

ARIZONA: 4 of 5 failed food businesses rated OK after re-inspections

Five food establishments failed health inspections and received provisional ratings in February.
For three of those — Las Cazuelitas, 234 E. 22nd St.; El Rio Bakery, 901 N. Grande Ave.; and Aqui Con El Nene, a mobile food unit — it was their first inspection with a new owner, said Sharon Browning, director of Pima County's Consumer Health and Food Safety Unit.
All three passed re-inspections.
A Domino's Pizza at 1751 W. Ajo Way and Taqueria Jenny's, 4207 S. Sixth Ave., also failed. Taqueria Jenny's passed its follow-up inspection but results from the Domino's re-inspection are pending, said Browning.

Rick Rhoads, the supervisor of Domino's in the Tucson area, did not respond with comments about any specific violations, but he said all were corrected within 72 hours.
Critical violations
•The inspector saw a live roach, at least 10 baby roaches — also alive — and one dead roach. The baby roaches were found in "what looks like corn meal" in a gap behind the cover along the base of the wall. The restaurant was ordered to clean food debris from under tables, counters and shelves and make repairs to prevent insects and rodents from getting inside.
• A spatula in a crate with clean utensils had dried food encrusted on it, and the crate itself had food crumbs in it. Utensils and equipment should be clean to the sight and touch.
• The inspector saw only one hand-washing sink in the facility, near the pizza preparation line. The restaurant was ordered to install another sink.
• Cooked chicken wings, sliced beef and chorizo measured at temperatures in the mid- to upper-40s. Ready-to-eat potentially hazardous foods need to be kept at 41 degrees or lower. The product was discarded.
• Cooked chorizo and cooked sliced beef under the pizza-preparation line were not marked with an expiration date. Ready-to-eat potentially hazardous food must be marked with an expiration date if it's not used within 24 hours.

• Violation: The restaurant serves oysters on the half shell but was not able to produce a 90-day record for oyster tags.
• Response: Las Cazuelitas had tags for oysters in the restaurant but not for the ones it had already served, said general manager Abelardo Frisby. According to the Health Department, shell stock tags should be kept 90 days from when the container is emptied. The restaurant now keeps the tags for its oyster containers, Frisby said.
• Violation: The hand-washing sink was not located for convenient use by the cook line.
• Response: The restaurant's management wasn't aware the sink location was a problem, Frisby said. A new sink was installed before the follow-up inspection.
• Violation: Raw shrimp was stored above uncovered salsa. Raw meat must be stored below ready-to-eat foods to prevent possible contamination.The shrimp was moved below the salsa.
• Response: All the restaurant's staff has had the necessary Health Department training and know raw meat shouldn't be above ready-to-eat food, Frisby said. In the day-to-day operations of running a restaurant, mistakes are sometimes made, but Las Cazuelitas employees know to separate food to avoid contamination, Frisby said.
• Violation: A crate of eggs on a table measured 67 degrees and two containers of milk in a reach-in refrigerator measured 51 degrees. They should have been held at 41 degrees or below.
• Response: The eggs were placed in a pan with ice to cool and the milk was moved into a walk-in refrigerator.
• Violation: The restaurant's menu didn't have a consumer advisory warning diners of eating undercooked food, but it serves oysters on the half shell and eggs any style.
• Response: The restaurant recently changed its menu and the advisory was left off. It was an oversight and was fixed, Frisby said.
• Violation: A can opener found in a food-preparation area had visible rust.
• Response: The can opener was removed and cleaned.

The owner, Griselda Vargas, responded to the inspection overall rather than to each violation individually.
"Everything is fine now, we just needed some reminders because we're new," said Vargas, who bought the business in November. "We're learning and getting ahead little by little. The inspectors were very nice and polite and they understand we're new and that we needed some help. We did everything they taught us."
She said the four employees received training about proper hand washing and food storage.
Critical violations
• Employees washed hands under running water with no soap for less than 20 seconds. Employees must wash hands with soap for at least 20 seconds.
• One employee drank and then handled food without washing hands. Another washed dishes, then handled clean dishware and food without proper hand washing.
• Employees placed drinks on a cutting board and on food-preparation areas. A half-eaten lunch was uncovered and stored on top of vegetables inside a reach-in refrigerator.
• Dried meat was brought into the establishment in unlabeled plastic baggies. All food must come from approved sources.
• The only hand-washing sink was in the grill area. There were no additional sinks in food-prep or dishwashing areas.
• A vegetable slicer was encrusted with food debris. The slicer had been used the day before and not cleaned.
• An employee handled a ready-to-eat pastry with bare hands. Employees must limit bare hand contact with read-to-eat food.
• A package of raw beef, raw pork and eggs was stored above some ready-to-eat foods. Food must be properly segregated to avoid cross contamination.
• An employee washed dishes using soap and water only. Food surfaces must be sanitized properly to avoid contamination.
• A pan of refried beans was being held at 103 degrees and a pan of soup was at 120 degrees in a hot holding unit. Potentially hazardous food should be held at a temperature above 130 degrees.
• A pan of soup that had been prepared the day before measured at 51 degrees in a reach-in refrigerator. Cooked food must be cooled from 70 to 41 degrees within four hours.
• A leaky faucet was dripping onto a dirty pan and into a pot of tripe in a three-compartment sink. Controls should be in place to avoid cross contamination from the dirty pan. The violation was corrected by re-washing the pot and tripe.
• A large container of refried beans, a container of rice and a pan of cooked green chiles had no date marks. Cooked potentially hazardous food that's kept longer than 24 hours must be date-marked.
• The establishment serves eggs cooked to order but does not have a consumer warning on its menu about eating undercooked food.
• A bottle of aspirin was stored near ingredients. Medicine should not be stored near food ingredients and employees should not prepare food when sick.
Taqueria Jenny's, 4207 S. Sixth Ave.
Failed Feb. 10 inspection. Passed follow-up Feb. 20.
"Everything was fine," co-owner Fernando Camacho said of the inspections. He said the department's inspectors served as educators for the three employees. Now they all are aware of proper food storage and keeping the refrigerator temperature set properly, he said in Spanish.
Critical violations
• Two bags of onions were stored directly on the floor. Food should be stored to prevent food contamination.
• Empty cups, mugs and an employee's salad were on a table near the drive-through window. Under the table were pots and pans. Employees should eat and drink only in designated areas.
• Six containers with seasoned, shredded beef that had been cooked the day before were in a refrigerator and measured at a temperature between 48 and 49 degrees. Prepared food should be cooled from 70 to 41 degrees within four hours. All six containers were discarded.
• Cooked shredded beef and rice in a refrigerator measured 44 degrees, and a whole chicken was at 45 degrees. Potentially hazardous food should be held at temperatures cooler than 41 degrees. The air temperature in the refrigerator was lowered to 39 degrees.
• A hand-washing sink wasn't working properly.
• Cleaning chemicals were stored on a window cell near spices and clean utensils. Other chemicals were stored near utensils.
• The mobile food unit did not keep its records up to date and didn't have all its food correctly date marked.

• Employees left the mobile food unit, but did not wash their hands before putting on new gloves. Other times employees washed dishes and put on gloves without washing their hands. Employees are supposed to wash hands before putting gloves on.
• Employees rinsed a spatula and two knives without using soap or detergent.
• An employee ate in the mobile food unit in a food-preparation area.
• Meat that had been prepared two days before hd no expiration date, which is required by the Pima County health code.

Investigators probing the sickness outbreak at Heston Blumenthal’s Fat Duck restaurant are focusing on staff infected by the winter vomiting bug.
Inquiries by The Mail on Sunday suggest 16 of the celebrity chef’s staff were struck by the norovirus before the restaurant closed late last month.
Four hundred people complained of illness after visiting the Michelin-starred venue in Bray, Berkshire.
Phillip Bicknell, leading the investigation for the local council, said of the outbreak: ‘There is strong suspicion that it is viral as opposed to bacterial.’
The norovirus can spread by breathing in the same air as someone infected. The Health Protection Agency said: ‘It may be caught from food contaminated by the virus from someone with symptoms.’
The Fat Duck reopened on Thursday. A spokeswoman said the figure of 16 ill staff was inaccurate.
The restaurant has been deep-cleaned, including anti-viral treatments for the walls, furnishings and carpets.

 

ALBERTA: Chestermere eatery fined for food-safety offences

A Chestermere restaurant has been fined $19,090 after a series of inspections over a three-year period found evidence of improper food handling.
Two members of the family that owns Chestermere Landing Steakhouse and Jovan's Pizza east of Calgary, pleaded guilty in provincial court this week to several counts of contravening the Public Health Act.
Nicola Burcevski, who has part ownership of the business, pleaded guilty to four counts, while his nephew, Zlatan Burcevski, the restaurant manager, pleaded guilty to three counts of violating sections of the Alberta Food Regulation, part of the Public Health Act.
Crown prosecutor Rob O'Neill said evidence entered into court details a history as far back as June 2005 and outlines 12 inspections in which violations were found.
Violations included failure to ensure food was protected from contamination, failure to ensure high-risk food was stored at proper temperatures, failure to ensure equipment and utensils in contact with food were sanitary, and failure to ensure handwashing stations were properly supplied with soap and papertowels.
Even after several inspections and warnings, violations continued, O'Neill said.
"You'd think that they'd be on their absolute best behaviour, but the violations continued," he said.
Owners at the restaurant, described as an upscale eatery with a beautiful view of Chestermere Lake, were unavailable for comment.

NEW MEXICO: Restaurants resist new letter grades

ALBUQUERQUE -- Albuquerque restaurants would be assigned report-card style letter grades instead of “red or green” certificates if a city councilor succeeds in revamping the food sanitation ordinance.
“It by no means is put forth to cause any hardship,” Councilor Trudy Jones told KRQE News 13. “It is just to give the citizens a better idea of what’s happening.”
City health inspectors currently judge food-service establishments including school cafeterias on a pass-or-fail system. The new system would assign A, B and C grades to restaurants who pass and a U for Unsatisfactory to restaurants that fail.
“We would like to make sure the citizens understand that when you get an A it is truly in good shape,” Jones said.
Some restaurant owners contacted by News 13 see no problem with the proposal that would return to a grading system abandoned years ago.
However the New Mexico Restaurant Association is among those who oppose it.
“A health department inspection sheet, while a matter of public record, is really a working document, a snapshot, that is provided by the health department to the restaurant owner and is not designed to serve as a guidepost to the general consumer as to the quality or purity of the food served in restaurants,” the association wrote on its Web site. “The fact that a restaurant is open for business indicates that no health hazard exists at that establishment.
"If a food service establishment poses a risk to human health, it should be closed on the spot.”
Under the proposed changes, restaurants that score 90 percent or better on official inspection reports would be assigned an A. Those who score 80-89 percent would get a B, and those scoring 70-79 percent would get a C.
The letter grades would be printed on signs that would have to be posted in the public view.
“In today’s economy we don’t need another regulation that’s going to add more cost to business,” Kathy Diaz, owner of Monroe’s restaurants in Albuquerque, said. “You could have an accumulation of very minor points that take you down to a B, for instance.
"What does that say to the public?”

The Health Protection Agency (HPA) has advised managers of the Fat Duck Restaurant in Berkshire that they can re-open tomorrow (Thursday March 12th).
The Agency and local environmental health officers from the Royal Borough of Windsor and Maidenhead consider it safe to reopen as the Fat Duck management has agreed to comply with all the recommendations made after a thorough risk assessment was carried out by the HPA’s Thames Valley Health Protection Unit and the environmental health team.
Preliminary findings from the investigation into what caused around 400 people to report being ill soon after eating at the restaurant have informed the advice given so far, but the investigation is ongoing. So far no one source has been identified.
Results of some tests are still awaited and the detailed questioning of people who reported illness is likely to continue for some weeks in order to build a more complete picture.
Risk assessments in outbreaks of illness connected to the food industry like this routinely include looking at any high risk foods from point of supply to the food reaching the plate; the environment – both in the restaurant and food preparation areas; cleaning methods and materials and food preparation. The restaurant will continue to work with the Health Protection Agency and the Royal Borough’s environmental health team until the investigation is completed.

UK: Could giardiasis be the Fat Duck culprit? An afflicted diner's first-hand account

This is his first-hand account of eating at the restaurant and what happened afterwards, an experience which he describes as “two weeks of serious unpleasantness”.
“I’ve always been intrigued by chefs and high-level cooking and I’ve wanted to eat the Fat Duck for years. You have to book two months ahead and you have to call between 10am and 10.10am, so it’s quite difficult to get in. It had taken Jo eight or nine phone calls to get the table but she’d managed it and she gave me the menu as a Christmas present. We were both really pleased.
“We had an 8.30pm sitting and we had the tasting menu. I absolutely loved it. It was everything I’d expected and more: the bacon and egg ice-cream, the sound of the sea, the snail porridge, the parsnip cereal, the savoury meringue. The highlight was the dish with the liquid nitrogen - so audacious, such magnificent theatre.
“The only things that felt a bit dodgy on the way down were the oysters. Neither of us is a huge fan, but we both ate them because we were determined not to miss out on anything. Anyway, we were eating in one of the most famous restaurants in the world so we were confident that there wouldn't be anything wrong with them. It was a fantastic atmosphere. Jim Rosenthal (another diner who has talked about how he fell ill) and his party were at the table next to us and we got talking to another couple who were also dining there as a Christmas present.
All the members of staff were magnificent. We had a bottle of relatively inexpensive white wine and the bill came to about £380.
“We left thinking ‘what a great experience’ but at 5am on the Thursday morning (two days later) Jo woke me up to say she was ill. She had had to rush to the loo and was being violently ill. This went on for about six or seven hours and she was really quite poorly. I felt distinctly queasy, clammy and hot but I thought I could keep it under control. We still got up the next day to go to the airport for our flight to Venice.
“I started throwing up on the Saturday morning. I was afflicted by violent stomach pains and diarrhoea. It was horrible, absolutely horrible. It was all made worse by the fact that we were in Venice so we were on boats and then rushing around trying to find euros for public loos. I was sitting in St Mark’s Square, absolutely whacked, and typing up all these wacky symptoms into Google, trying to find out what was wrong with us.
“We came home and it went on for about a week, with both of us dragging ourselves around. Neither of us could eat – I lost half a stone. We almost suffered a kind of depression – it really laid us low. The symptoms were such that I thought there was something wrong with my liver or bile ducts, it was very deep, very systemic. When I put all my wacky symptoms into Google, it came up with hepatitis or giardiasis, a parasite that can get into the intestine.
"Ten days later I had to drive to Lyme Regis for a broadcast and I was coming back at midnight when I heard on the news that Heston Blumenthal had closed the restaurant.
I hadn’t made the connection; that it was the meal at the Fat Duck that had made us so ill. I remember thinking that surely it wasn’t possible that the second best restaurant in the world could have poisoned us. I got back home, woke up Jo, and said ‘Guess what?’
“The next day I went onto the Fat Duck website and sent them an email. At that point the news bulletins were saying that 40 or so diners had been affected and I wrote something to the effect of: 'This has happened to us as well. We loved the meal and we’re not angry but count us among the walking wounded and let us know what's happening.’
“We received no reply so I wrote quite a long letter. I haven’t received a reply to that either. I’m appalled because I was so entranced by Heston Blumenthal and he comes across as being very decent and clever. We had been so ill and, at the very least, we expected some kind of acknowledgement. We really thought they would be interested in what had happened to us.
“Jo is still a bit wan and I still feel a wee bit under the weather. It was two weeks of serious unpleasantness; it was an alarming experience, the last thing you'd expect when you go to a restaurant like the Fat Duck. I'm not angry that it happened because obviously it wasn't a deliberate thing. My anger is that neither Heston Blumenthal or his management have contacted us. The rest is just curiosity really. We want to know: what made us so sick?”

What is it about the wearing of food preparation gloves that food handlers find so difficult to understand? It's not that hard. The hand with the glove touches the food and the hand without the glove touches the money. But somewhere between the Food Safety Act and the shop counter, it all goes horribly wrong.
All over the country in delis, takeaway outlets and cafes, ungloved left hands and gloved right hands are mingling in cash registers with the same symmetry that moments before caressed a toasted chicken sandwich or a salad roll. Smiling shop assistants are carefully counting out ham slices with the same gloved hand that just counted change to the previous customer.
As a very right-dominant person, I sympathise with those whose other hand is more adornment than useful, and who need to use both hands to dispense change. However, this genetic shortcoming is easily fixed by putting on a fresh glove before touching food - any food, especially my food.
I was convinced we have a serious problem in this city the day I witnessed arguably the worst breach of food-handling etiquette since Viktor Yushchenko sampled that fateful buffet.
Entering the washroom of a shopping centre, I saw an aproned shop assistant leaving a toilet cubicle still wearing a food-handling glove. I watched her approach the hand basin, remove the glove, rinse it out, cursorily dry it under the hand drier, put it back on and leave the washroom! I was determined to follow Lady Salmonella to her workplace, but by the time I caught up she was wearing the still wet glove and blithely buttering the roll of an unsuspecting customer, dispensing e-coli free with every focaccia.
I am tired of carrying this burden alone; tired of knowing that the gloved hand I just watched pick up coins from the floor is going to serve me next without so much as the snap of fresh latex in between. I am tired of waiting for ages to be served by the safe handler I have staked out, only to have Bacteria Betty step in and take my order instead.
Perhaps it was better in the old days when nobody wore gloves and food handlers carried and distributed germs equally. At least it was an equitable arrangement - we all took the same risks and were served faster by not wasting time on gratuitous attempts to appear hygienic. If you agree, raise your gloved hand.

CALIFORNIA: Restaurant to Yelp reviewers: Bring it on

A San Francisco restaurant has figured out a way to wrest power from Yelp, the review site that has many small business owners feeling frustrated and voiceless.
Pizzeria Delfina, a Mission District institution, is flaunting Yelp reviewers’ mean-spirited, one-star reviews with pride. The restaurant made T-shirts quoting bad reviews and gave them to employees to wear on the job.
Now, when customers order a margherita pizza with fior di latte mozzarella, tomato and basil, their server might bring it to them wearing a T-shirt that reads: “The pizza was soooo greasy. I am assuming this was in part due to the pig fat” under a rating of one out of five stars. Or, when people write their name on the chalkboard of the pizzeria and order a glass of wine to sip on the sidewalk while they wait, they might be greeted by a host wearing a T-shirt declaring that “This place …” (well, you’ll just have to go see for yourself, as we do not want to offend your sensibilities by printing the rest of the quote.)
“We were just having fun with Yelp. It kind of takes the seriousness out of it and pokes fun at it a little bit,” said Anne Stoll, who owns Delfina with her husband, Craig Stoll. “We really have no recourse. Anyone can write anything they want on Yelp. There are no checks and balances, so this is our way of being able to have a voice.”
Yelp is active in 24 cities but in San Francisco, where the site started, it is especially popular with users and powerful in the local economy. As I wrote in an article earlier this week, many small businesses are frustrated that they cannot publicly respond or dispute false reviews on Yelp and that they do not understand how the site ranks reviews.
“The small businesses are kind of fed up with it, and this was our way of dealing with it,” Ms. Stoll said.
The restaurant’s manager and a T-shirt designer who was creating shirts to sell to the public came up with the idea in the fall, Ms. Stoll said. She loved it and went on Yelp to pick “the funniest, worst reviews.” Since staffers started wearing the shirts, Ms. Stoll has heard other business owners saying they are going to make their own.
Pizzeria Delfina is a hit on Yelp, with four out of five stars and 623 reviews. Most of the reviews run along the lines of “LOVE LOVE LOVE Pizzeria Delfina and can’t wait to go back!” and “Um, pizza alla carbonara? Can you say: AMAZING? … it’s probably the richest most savory pizza I’ve ever had … it’ll be a while before another pizza can top this.”
Still, Ms. Stoll said, “People can be so brutal and so mean and can write things that aren’t true, and anything negative said about us does sting.”

 

ONTARIO: Durham restaurants draw yellow and green cards

DURHAM -- Diners in Durham can now look for the green go-ahead for health-inspected restaurants.
With the launch of the new DineSafe program, food establishments -- including restaurants, grocery stores and day cares -- must display a green, yellow or red sign based on their inspection status. Green means all is well, yellow means the establishment was substantially not in compliance with provincial rules and a red means a closure.
On Monday March 2, the first round of inspections under DineSafe resulted in two yellow cards, for the Akashia Japanese and Korean restaurant on Kingston Road West in Ajax and Wie Geht's Amigo on King Avenue East in Newcastle.
Ken Gorman, director of environmental health for Durham, said the Ajax restaurant received a yellow because of the level of cleanliness of food contact surfaces, food storage issues which could result in possible contamination and temperature abuse. The Newcastle restaurant's citations included food not being stored at the proper temperature, lack of paper towels and soap at the food and hand sink areas and sanitation problems with the floor, walls and equipment.
Both restaurants have been re-inspected and received green cards.
Doris Paxis, manager at Wie Geht's Amigo, said she got her green sign Thursday.
"I had electrical work done, because of that I had a yellow sticker, but clearly I have a green now," she said.
Ms. Paxis said she didn't get comments about the yellow from customers and doesn't think it will affect them coming into the restaurant. Overall she said she thought the new DineSafe program was fine.
The owner of Akashia, who did not provide his name, spoke through a friend translating to English. The restaurant indicated they thought the problem was that they had been using cleaned soy sauce buckets to store items like flour and sugar.
The restaurant received a green card within 24 hours of the initial inspection.
"Now is everything fixed, only one day yellow, so it's not a big deal," said the friend.
Overall on March 2, 30 other establishments got green cards. The next day, 35 put green signs in their windows, including Akashia, and there were no yellows.
Among those getting the green go-ahead was Applebee's in Ajax on Kingston Road. Kitchen manager Norman Schwehr said it wasn't any different from previous inspections, though some customers have asked what the green card means.
"I think people who go to restaurants want to know what's going on in the restaurant where they're eating," he said. "If there's a green card in the window, personally, I'd be very happy to go into that place."

Boxing promoter Frank Warren has laid in to Heston Blumenthal's Fat Duck restaurant after becoming one of 400 diners who fell ill.
Warren said he was "very disappointed" with his treatment after becoming sick following his visit.
Initial estimates suggested up to 40 people were struck down after eating at the three-star Michelin restaurant in Bray, Berkshire.
But the figure has now leapt to 400 possible cases, said investigators from the Health Protection Agency (HPA).
The TV chef last week decided to close the famous restaurant after diners suffered vomiting and diarrhoea, and was hoping to reopen just days later.
Tests by his own food consultants ruled out food poisoning, indicating it was likely to be a gastro virus.
However, environmental health officers and the HPA have begun further tests on the restaurant, famed for dishes like snail porridge and sardine on toast ice cream.
And now the restaurant faces the prospect of being closed for weeks.
Boxing promoter Warren added to Blumenthal's woes by criticising the restaurant's response to the outbreak.
"Everything was fabulous about the evening - the food, the setting, the service, it was unbelievably good but unfortunately, afterwards, all of us were ill," he said.
Warren, who had dined at the restaurant as a guest, along with television sports presenter Jim Rosenthal, said he heard very little from Blumenthal's team following the outbreak.
He said: "Since then we have not heard anything from the restaurant at all.
"I am very disappointed and I know that the people I went with are very disappointed with the feedback."

LONDON -- Was it something in the air? Was it something in the food? Was it some unspeakable organism lurking evilly on a countertop or skulking under a plate?
Whatever it was, it has caused hundreds of people in the past month to report becoming violently sick with projectile vomiting, sudden diarrhea and flulike symptoms after eating at in Bray, Berkshire. The Fat Duck, which has three Michelin stars and is perhaps Britain’s most celebrated restaurant, has closed. The outbreak’s cause remains a mystery.
Britain’s Health Protection Agency said it was testing the food, testing the people who had become ill and conducting a “risk assessment of all food storage, preparation and cooking processes.” It is testing for bacteria, viruses, patterns in the sick people’s symptoms and in the food they ate and, for good measure, testing other diners, whether or not they got sick.
“They’re looking for a bug,” said Phillip Bicknell, a local government official, “something that’s causing the sickness, that may well be attached to the restaurant, inside or outside, or to the staff who work there, or to a customer who came in.”
The restaurant’s reopening depends on when the testing is completed.
The restaurant’s owner, the celebrity chef Heston Blumenthal, decided to close it on Feb. 24 after about 40 diners said they had become ill after eating there. As news of the outbreak has spread, about 400 people in all have reported being sickened from late January through most of February.
Mr. Blumenthal declined to comment. But a spokeswoman said that none of the tests had so far proved conclusive.
The British news media have speculated that Mr. Blumenthal could be losing as much as $140,000 a week, merely in lost reservations. A regular dinner at this small restaurant in the country costs about $140, without wine. The tasting menu costs about $185.
Mr. Blumenthal said last week that he felt “dreadful, absolutely dreadful,” and that closing the restaurant had been “an incredibly emotional decision,” a newspaper article in The Independent reported.
The Fat Duck is considered one of the world’s most innovative practitioners of molecular gastronomy, which uses science and technology to invent new forms and combinations of food. (Mr. Blumenthal prefers the term “sensory design.”)
Although his menu includes semi-conventional dishes, Mr. Blumenthal is perhaps best known for items like snail porridge and “nitro-scrambled egg and bacon ice cream” (served with tea jelly).
His Sound of the Sea dish includes seafood, foam and what some reviewers have called “edible sand.” It is served alongside a conch shell with an iPod in it, so diners can listen to wave and seagull sounds as they eat.
Mr. Blumenthal is known for professionalism and meticulous attention to detail. He told the BBC that the restaurant regularly conducted its own tests. “Everything is tested, from the food coming out of the ground, from the farm, into the kitchen and to the customer,” he said.
He also owns a pub in Bray, but no one has gotten sick there, said Mr. Bicknell, the local official.

More than 1,000 people face medical checks after health officials widened their investigation into a mystery illness which has struck diners at one of Britain's best restaurants.
Hundreds more people have reported falling violently sick after eating the exquisitely complex dishes at the Fat Duck in Bray, Berkshire. In an extraordinary turn of events in the week-long enquiry, the Health Protection Agency (HPA) said the possible number of cases at Heston Blumenthal's world-renowned establishment was 400 – 10 times as many as was previously known.
Officials said they intended to trace every person who had eaten at the restaurant – one of only three in Britain with three Michelin stars – since the outbreak began in late January. Given that the Fat Duck seats about 40 for each heavily-booked lunchtime and evening session, samples are likely to be requested from up to 1,600 diners.
Scientists are baffled by the cause of the illness, which has left victims with vomiting and diarrhoea. The tests that have come back so far have found no evidence of anything untoward – perplexing Blumenthal and all involved – but possible causes are a gastro virus or food poisoning.
Richard Harden, the co-editor of Harden's restaurant guides, said: "It is astonishing. In my 18 years following restaurants I do not believe there has ever been another incident at a restaurant like this. I can't think of a major outbreak. It's bizarre."
Blumenthal, 42, shut his restaurant on 24 February before calling in environmental health officers from Windsor and Maidenhead council. When he contacted The Independent to announce the closure last Friday, the celebrity chef – who is known for his scientific approach – said between 30 and 40 diners had reported falling ill in the previous three weeks.
In its first statement about the outbreak, the HPA, which was called in by the council, said the Fat Duck's managers were "co-operating fully", and added: "The number of possible cases reported to the restaurant has risen since media coverage of the outbreak, to about 400 going back to late January and mostly through February."
Dr Graham Bickler, regional director of the agency's South-east region, said the outbreak was "very complex". "We are working closely with the restaurant and with colleagues in the Royal borough's environmental health team to explain what happened and to ensure that the risks of it happening again are reduced as much as possible." Scientists are examining food samples and specimens from diners and the Fat Duck's 60 staff, while conducting a "risk assessment of all food storage, preparation and cooking processes". Laboratory tests will check for possible contamination of food by bacterial or viral germs, which might have occurred at any time from "before supply to the restaurant to reaching the plate".
The HPA said it was investigating the characteristics of every person affected, their symptoms and the food they ate. It added that it was planning further tests on "all those who ate at the restaurant during this time, whether they reported being ill or not".
A spokesman for Blumenthal said that when he first alerted the media about the closure he hoped to re-open this week, but the date had been put back several times. A source close to the chef added: "He is waiting to be briefed. He is behaving as a man who is watching his restaurant being pulled to bits, the cause of which is unknown."
The outbreak is a major personal and financial blow to Blumenthal, who has a reputation as Britain's most complex and brilliant culinary alchemist. His wackier dishes include snail porridge and nitro green tea and lime mousse. Channel 4 began screening his latest television series, Heston's Victorian Feasts, this week.
What could it be? Four theories
Food poisoning: Vomiting and diarrhoea are commonly associated with food poisoning and symptoms may present themselves days or even weeks later. Tests so far have found nothing to support this theory. The Fat Duck is an extraordinarily complicated and, by all accounts, spotlessly clean restaurant with 42 chefs who use "thousands" of ingredients. The problem may lie here or with one of its 30 suppliers.
Gastro virus: Experts are checking whether a stomach bug could have been passed by a member of staff preparing or serving the food. If infected, he or she may be showing no symptoms. Bacteria may be hanging around on kitchen surfaces.
Winter vomiting bug: This nasty illness – and flu – usually peak earlier in the winter. It is possible there is no link to the Fat Duck because the number of cases is still increasing, making this theory look less likely.
Sabotage: One national newspaper has hinted at sabotage, with reports that locals were unhappy about noise and fumes. This is thought to be highly unlikely but, with no other proven source, it cannot be ruled out.

The "culinary alchemist" temporarily shut The Fat Duck as a precaution after around 40 customers were taken ill over the last couple of weeks.
Blumenthal had hoped for the all-clear from environmental health officers yesterday, but inconclusive test results meant he was unable to reopen the Michelin-starred restaurant in Bray, Berkshire.
The Fat Duck is now expected to remain closed tomorrow.
Today a spokesman said the chef was "upset" and "frustrated" by the health scare.
"We are still waiting for the final results to come back but all tests so far have been negative," the spokesman said.
"We will not be opening tonight and it is unlikely that The Fat Duck will open tomorrow.
"Obviously he (Blumenthal) is upset and frustrated. He would like things to get back to normal as soon as possible but for now his priority is to make sure we get to the bottom of what's happened."
The investigation, which began after the restaurant was closed last Tuesday, has led to financial losses in the region of £100,000.
About 500 guests had their reservations cancelled at the £130-a-head restaurant.
And customers will continue to be turned away until the investigation yields results.

Mom-and-pop food stores and restaurants across the GTA are being scammed by fake health inspectors pushing unnecessary food and water tests, authorities say.
Dozens of convenience store and restaurant owners, most of them new Canadians, have told Peel, Halton and Toronto health departments that they were contacted by a "food and water safety technician" wanting to sell them $30 to $40 safety tests.
The so-called technicians reportedly say the tests are mandatory, and hand out what looks like "old meat plant inspection forms" from the Ontario Ministry of Agriculture, Food and Rural Affairs, said Matt Ruf, Halton Region's manager of food safety.
Halton and Toronto officials said the people typically identify themselves as representatives of the Canadian Food Safety Institute or the Canadian Food Safety Resource Centre, which the institute founded according to the website www.cfsrc.com.
The CFSI "is not an agency we would deal with," said Rob Colvin, manager of healthy environments for Toronto Public Health.
So far, only a handful of business owners – including two in Toronto – have paid for the tests, officials said.
The cases started emerging first in Peel and Halton in mid-January, then in Toronto about three weeks ago, Colvin said.
Jalal Hadibhai, who owns the Down Under convenience store in Yorkville, said a woman called Monday, saying she would send a technician the next day to perform E.coli tests in the store.
She wanted $39.95 in cash or cheque, he said.
Hadibhai called Toronto Public Health to ask if the tests were legitimate and was told no, he said.
In the end, no one came to the store.
"I would have asked for I.D.," the store owner said. "I would never give them cash."

The owner of a popular Chinese restaurant has been fined after his eaterie was found to be infested with vermin.
The Peking Villa on Linthorpe Road was inspected after Middlesbrough Council officers passed the back entrance on September 1 last year and saw meat hanging from the door.
Ruth Pallister, for Middlesbrough Council, told how owner Yiu Keung Lau, 44, was present during the inspection.
Mrs Pallister said: “An inspection throughout the premises included the kitchen, bar and dining area.”
She told Teesside Magistrates Court how mouse droppings were on containers near cooked and uncooked food.
The cooking rig was covered in a thick layer of grease, some food preparation areas had not been cleaned for some time and boxes of duck, pork and chicken’s feet were left unrefrigerated.
During an interview with council food hygiene specialists in October, Lau admitted he knew about the state of the kitchens and the rodent infestation, but said that since the inspection he had stepped up efforts to maintain high standards.
The family man, of Kenton, Newcastle, pleaded guilty to eight counts of flouting food safety laws.

The Victoria City-County Health Department and its sister organization, the Crossroads Public Health District, inspect places where food is served in Victoria, DeWitt, Jackson and Calhoun counties.
In the inspection reports, each violation in the Food Temperature/Time Requirements category is 5 demerits; in the Personnel/Handling/Source Requirements category, 4 demerits; and in the Facility and Equipment Requirements, 3 demerits. Zero is a perfect score while 100 demerits is the worst possible score.
Each Wednesday, the Advocate publishes inspection results from the previous week. All demerits are reported, but only those in the categories of Food Temperature/Time Requirements and Personnel/Handling/Source Requirements are detailed.

NEW BRUNSWICK: One year after government started posting restaurant inspections online, compliance has improved

One year after the health department started posting inspection reports on its website for everyone to see, officials have seen a definite increase in compliance by restaurants who want to make a good impression.
"Compliance has gone up and if our inspectors find something, the restaurants want to hurry up and comply. If we give them five days to fix something, they usually say they'll have it done in two days and want us to come back for the re-inspection," says Nina van der Pluijm, regional director for health protection programs for the New Brunswick Department of Health.
"The public likes to know what is going on and be able to read a report on a certain restaurant, see the ranking and be able to see what they did to get that ranking."
The health department first started posting restaurant health inspection results online back in July of 2007, but the idea drew criticism from the industry because it was a colour-coded system and didn't really explain to people why a particular restaurant got a green (which is good) or a red (which is very bad). The system was updated in December of 2007 when the department started posting copies of the actual inspection reports, complete with checklists and handwritten comments from the health inspectors. So, for the last year, restaurant owners and customers are able to log onto the health department website and see the actual reports for hundreds of restaurants, from A&W to Zellers. The Food Service Establishment Inspection Results cover restaurants, take-outs, school cafeterias, bakeries, convenience stores, pizza shops, arena canteens, coffee shops, beverage rooms and any other place with a licence to prepare and sell food.
van der Pluijm says establishments are inspected every one to three years depending on their risk category and the inspectors always show up unannounced. The inspectors carry a checklist that includes food storage, food preparation, food display, equipment and utensils, employees, cleaning and sanitation, the general cleanliness and upkeep of the building, water supply, lighting and ventilation. Restaurants can be marked as satisfactory, unsatisfactory, minor infraction, major infraction and critical infraction. Their final grades are colour coded as green, yellow, dark yellow, red with warning stripes and critical red, which means a shutdown.
A check through the list as it was posted yesterday showed the vast majority of restaurants in New Brunswick have green rankings, with only a few yellow warnings.
One restaurant owner, who spoke on condition of anonymity, said the industry generally likes the idea because it keeps them on their toes. He said franchise restaurants are also inspected regularly by their own regional offices. But while restaurants know food handling and cleanliness rules, they can't help being a little messy sometimes.
Luc Erjavec, a spokesman for the Canadian Restaurant and Foodservices Association in Halifax, says the fact that there is a high rate of compliance and few infractions is proof that restaurant owners put food safety at the top of their priority list.
"The levels of infractions are very minor and the incidents of food-borne illnesses in New Brunswick and Nova Scotia, along with all this disclosure, show there is no smoking gun and the industry is doing a pretty good job at food safety on a day-to-day basis."
However, he said the industry generally doesn't like the colour-coding system because the general public might not try to understand it.
"They might look and see a yellow and move on without taking the time to see why, and the reports could give a restaurant a bad name for a relatively minor incident."
Duncan Hutchison, instructor with the cook training program at NBCC Moncton, said his students are taught proper food handling techniques. He said he supports the online posting of restaurant rankings as long as people are aware of what the colour codings actually mean.
He said the good thing about all this is that the department has put on more inspectors and they are getting around to more places more often.

 

KOREA: Comprehensive inspections on cafeteria, strengthened penalties

As food safety accidents continue throughout the world, the Korea Food and Drug Administration (KFDA) said that it would conduct comprehensive inspections on 66,000 cafeterias in schools, hospitals, and industrial companies and reinforce the penalties for food poisoning.
According to the KFDA, it will introduce a molecular epidemiology analysis method and a simple inspection method to promptly trace the origin of food poisoning. It will keep on strengthening the penalties for a cafeteria when a food poisoning accident occurs. It will prepare a ‘food poisoning prevention plan,’ which will include reinforced penalties for a cafeteria with a food poisoning accident. It will also prepare a pan-governmental response system to promptly prevent food safety accidents.
Specifically, the KFDA will officially manage the ‘pan-governmental food poisoning countermeasure committee,’ which will involve government departments, local government groups, and the food industry. It will also increase the current penalties worth ?3 million to a maximum of ?5 million depending on the number of violations. It will reduce the number of people affected by food poisoning accidents to 100 out of one million people. It will focus on reducing the norovirus food poisoning rate to 10%.
Furthermore, the KFDA will conduct comprehensive inspections on facilities in daycare centers and nursing homes to prevent food poisoning. It will also conduct norovirus contamination inspections on schools and training centers that use well water. It will provide guidance and conduct inspections several times a year on 46,000 facilities, including schools, kindergartens, senior centers, and facilities for the handicapped.
