FLORIDA fails to perform required food inspections

State food monitors aren't performing required inspections for more than a fourth of food service establishments that pose the highest risk to the public, said a report from the state accountability office.
Three state agencies are responsible for ensuring the safety of food service operations across Florida, from day care centers to deli counters. But they are not performing inspections as often as the law and department rules require, said the December report from the state Office of Program Policy Analysis and Government Accountability.
"For two departments … firms posing the highest risk to the public were more likely to miss inspections," said the report.
The Department of Health had the worst record. Its lowest risk establishments, such as bars that limit food service, received their required one visit a year. But nearly a third of the highest-risk operations, those serving children and people who are ill, didn't get the required four inspections a year.
More than a fourth of the highest risk operations inspected by the Department of Agriculture and Consumer Services – such as grocery stories with sushi and sandwich counters – received fewer than the four required inspections.

PENNSYLVANIA: Little bite put in restaurant inspections

What if roaches outnumber employees in the kitchen of your favorite restaurant? Or ready-to-serve sushi festers in a faulty cooler? Or the buffet table serves lukewarm foods poised to make you sick? Someone would find out, someone would do something, right?
If you dine out in Allegheny County, that's not necessarily so.
The Post-Gazette recently reviewed inspection reports for the last three years for 94 restaurants in Ross, one of the largest concentrations of eateries overseen by county health inspectors. In addition, as a kind of check, the paper reviewed the most recent inspections for a sampling of 27 restaurants in other parts of the county.
Among the findings:
• Many restaurants are not being inspected a minimum of once per year, as promised by Allegheny County Executive Dan Onorato two years ago.
• When inspectors do show up, they typically find multiple critical food safety violations, indicating restaurants are putting customers at increased risk for food-related illnesses.
• What's more, the health department almost never takes action against restaurants for repeated violations, giving restaurant operators little incentive to do better.
Mr. Onorato's promise of once-a-year checks came as he announced the addition of three people to the health department's restaurant inspection team after a task force recommended the hires.
Despite the increase in staff, Mr. Onorato said at the time, "I want the public to know there has been absolutely no cut, and no slacking, on the inspections of restaurants in Allegheny County."
But according to the most recent inspection reports, 32 of the 94 restaurants in Ross, or roughly one in three, went more than a year between inspections. Of those, the average time between inspections was 19 1/2 months. Inspections at 10 of the overdue restaurants were performed immediately after the newspaper made its request to look at the files.
Among the sampling of 27 restaurants from around the county, results were even worse. Roughly half (12 of 27) were not inspected annually. On average, those restaurants went 18 months between inspections.

KOREA: Restaurants using food leftovers

The government has joined forces with consumer protection agencies and restaurant associations to campaign against the reuse of leftovers at restaurants. At an event hosted by the Health, Welfare and Family Affairs Ministry, participants pledged to serve a consumable amount of food and not to reuse food leftovers; make it rule to order an amount of food they can consume; eat all food served; and to use and promote restaurants not reusing leftovers. Rather than finding the campaign necessary, the seriousness of the leftover reuse problem is such that the government has had to step in.
Suspicion has been repeatedly raised over the past few months that certain restaurants reuse food and side dishes left over. TV stations aired several times in August and September the practice of leftover reuse and unhygienic food handling at restaurants. Notably, the three largest broadcasters spotlighted the widespread practice of leftover reuse with shows such as, “Only Customers Do Not Know This: Leftover Reuse (KBS)”; “Reuse and Re-reuse: Controversy over Side Dish Reuse at Restaurants (MBC)”; and “Shocking Controversy over Leftover Food Disposal (SBS).” While embarking on a campaign to end leftover reuse, the Health Ministry has failed to conduct its own survey.
Certain Korean restaurants and those serving homestyle meals are reportedly serving side dishes left uneaten by a patron to other customers, and even main dishes such as soups and stews by reheating them. Korean sushi restaurants often wash and reuse decorative shredded radish. Serving food unconsumed by other people not only makes customers feel uncomfortable, but also poses health risks. Food poisoning is a real danger, as is the spread of the hepatitis A virus that is transmitted via saliva. Ethics in restaurant operations have lamentably collapsed.
Of the 20 restaurants chosen randomly by a KBS investigative news magazine, 16 were found to have reused food. The ministry will revise a food hygiene law and shut down restaurants caught for a third time for serving leftover food.

LOUISIANA: Restaurant report card: who scored worst?

LOUISIANA. -- If you're heading out to do some holiday shopping this weekend, think twice before you decide where to stop and eat.
WDSU investigated the low-scoring restaurants in Jefferson Parish in this week's Restaurant Report Card.
The first stop was Caffe! Caffe! on Clearview Parkway, where inspectors found the following critical violations:
- Food meets the definition of adulterated.
- Food contact surfaces and utensils are not clean to sight and touch, specifically the ice machine.
Over the phone, Caffe! Caffe! management told WDSU that all critical violations were corrected immediately.
"We've always taken food and health safety very seriously," the restaurant representative said. "All employees go to ServSafe classes. And we conduct detailed cleanings several times a month."
The next stop was Shogun Restaurant on Veterans, where inspectors found:
- Food stored for cold-holding and service was not held at a temperature of 41 degrees or below.
- An employee did not wash hands.
- Food contact surfaces and utensils are not clean to sigh and touch, specifically the ice machine and soda dispensing machine.
- Insects are present in the establishment.
Shogun management did not want to talk on camera, but the owner released a statement.
"We've been open since 1981. Food safety is important to us," the owner said. "We are a family-run restaurant and value our customers and want to make sure their dining experience is of the highest quality. We regret that the violations happened, but we corrected them immediately."
From there, it was on to Houston's, also on Veterans Boulevard. According to health inspection reports, roaches were found in the dry storage area. Management referred WDSU to the restaurant's corporate office.
Houston's management released this statement:
"Having received positive health inspections for over 20 years, we were terribly surprised and disappointed with the most recent health inspection report. Since then, our management and staff have redoubled our commitment to maintaining the highest standards of cleanliness and sanitation in the restaurant industry," general manager Troy Monconduit said.
"We want to assure our loyal guests that their well-being and safety has always been our highest priority and we look forward to serving them with excellent food and outstanding service in the years to come."
And restaurants with zero violations include Texas Roadhouse Grill, Scooters Chicken Delivery, Tony Mandina's, Seafood Heaven, Sbarro and Smoothie King on West Esplanade.

 

ARIZONA: Follow-up inspections give OK to 2 eateries failed in Nov.

El Minuto Café, a downtown favorite for Mexican food for 72 years, was one of two restaurants to fail unannounced county inspections in November.
El Minuto, 345 S. Main Ave., and Jerry Bob's Family Restaurant, 2680 E. Valencia Road, passed follow-up inspections that returned their regular licenses to serve food.
Eight other food establishments scored "needs improvement" ratings from November inspections.
A county sanitarian flagged El Minuto for seven critical violations in a Nov. 19 inspection. Five or more critical violations result in a "provisional" rating that requires the food establishment to pass a follow-up inspection to restore its regular license.
The sanitarian observed employees having bare-hand contact with ready-to-eat foods, and also noted two live roaches and several dead ones in a wood cabinet, and "a sewerlike odor in the restroom area."
The sanitarian reported that the restaurant lacked a mop sink and sufficient hand-washing sinks.
The restaurant's violations primarily involved infrastructure or procedural issues, all of which have been taken care of, said George Shaar, a member at large of El Minuto's ownership group.
"There were things that didn't affect the well-being of the public but didn't satisfy the fine lines of the food code," Shaar said. "We want to reassure the public that we have taken care of everything and that we are committed to satisfying our customers and doing the best job we can for them."
Because El Minuto has received prior violations for employees not properly washing their hands, installing a hand sink in a different area should optimize hand-washing procedures, said Sharon Browning, program manager for the county's Consumer Health and Food Safety unit.
"What happens with older restaurants is that when the food code was written, it just said you need a hand sink, but it didn't tell you where you had to put it," Browning said. "The new food code talks about having them in certain areas, and I really believe that's for the betterment of public safety. In this case, there was a lack of infrastructure that was causing the employees not to wash their hands."

Fewer staff members and flat budgets at the state Health Department this year are prompting restaurant inspectors to place more emphasis on higher risk and repeat-offender establishments.
Hank Hartsell, deputy commissioner of protective health services, said restaurants typically are inspected twice a year.
"We place a higher priority on investigating complaints that indicate risk or potential harm,” he said. "That doesn’t mean we’ve stopped doing inspections.”
Restaurants that heat, cool and reheat foods are considered higher threats because of the potential for food-borne illness. Conversely, businesses that serve prepackaged food are considered less of a risk, Hartsell said.

Having 10-day old baby Sorenne means a lot of sitting around. Seriously, the kid must have breasfed for 12 hours yesterday. And that means a lot of bad TV for Amy and Sorenne. Lately, it’s been a Real Housewives of Orange County marathon. I don’t know who lives like that and I don’t know what’s real about those people, but those ladies need to get their botoxed faces and fake bobbies and restylane lips down to the Orange County Board of Supervisors.

After watching the mish-mash of federal, state and local approaches to restaurant inspection in a number of western countries for the past decade, I can draw two broad conclusions:
• Anyone who serves, prepares or handles food, in a restaurant, nursing home, day care center, supermarket or local market needs some basic food safety training; and,
• the results of restaurant and other food service inspections must be made public.
Publicly available grading systems rapidly communicate to diners the potential risk in dining at a particular establishment and restaurants given a lower grade may be more likely to comply with health regulations in the future to prevent lost business.
More importantly, such public displays of information help bolster overall awareness of food safety amongst staff and the public -- people routinely talk about this stuff. The interested public can handle more, not less, information about food safety.
And instead of waiting for politicians to take the lead, the best restaurants, those with nothing to hide and everything to be proud of, will go ahead and make their inspection scores available -- today. Demand it ladies.

It was the second time that county supervisors rejected using a system that's become nearly universal in Southern California -- using letter grades to measure restaurants.
Orange County does not require its 13,000 restaurants to post letter grades after health inspections. Instead, restaurants are required to post certificates showing that they have met food preparation and cleanliness standards or are scheduled for a reinspection because of past violations.
In May, the Orange County Grand Jury concluded that the county's current system essentially keeps the public "in the dark" about a restaurant's record and suggested the county's Health Care Agency require restaurants to post letter grades so the public knows how they scored in their last safety inspections.
Citing a Stanford University study, the grand jury also noted that instances of food-borne illness declined in Los Angeles County after it adopted the letter grading system in 1998 and said that most Orange County restaurant customers don't even notice the certificates they are currently required to post.
But supervisors Tuesday declined to adopt the letter grading system or an alternative plan that would have required restaurants to post color-coded certificates to provide more information to customers. A yellow certificate would have indicated that the restaurant had been cited and was now scheduled for a reinspection.
Instead, supervisors opted to redesign certificates to more prominently display "reinspection scheduled" for those restaurants that had enough violations to warrant a follow-up visit by the health department.
Supervisor Bill Campbell, who once owned a chain of Taco Bell franchises, said he thought it was unfair to punish restaurant owners with grades or color codes if they had corrected problems and met health standards. The county Health Care Agency will not allow restaurants to open if they fail to correct significant health violations.

The Board of Supervisors is expected to resume its debate tomorrow about whether to change the county’s restaurant health inspection practices and move closer toward adopting A-B-C grades in restaurants like they have in Los Angeles.
The issue has been brewing a long time. Earlier this year, an Orange County Grand Jury found that the public is not aware of how to get information about health inspections and recommended that O.C. adopt L.A.’s method.
Health inspectors recommended the county take a different approach, and require restaurants to display color-coded placards in their windows. Red means the place has been shut down, yellow means it’s safe but some serious problems triggered the need for a re-inspection, and green means it passed without major problems.
Last week, the supervisors seemed to back away from those two options in favor tweaking the county’s existing program, which includes a web site and placards that indicate the restaurant has passed its inspection.
The supes said they were concerned the other options could hurt restaurant owners by marking restaurants that had been cleaned up as dirty. Supervisor Chris Norby said there’s no need to change the system because there’s no safety risk here — the county doesn’t have a big problem with foodborne illness.

 

MICHIGAN: Restaurant not to blame for illnesses

Cheboygan, Mich. -- A mysterious sickness that hit party-goers at a Dec. 7 barbecue held at a downtown Chebogyan restaurant was not related to food served there, a health official said Friday.
Kevin Prevost, an environmental sanitarian with the District Health Department No. 4 office in Cheboygan, said that a norovirus was more than likely the malady that left several attendees of the private party at Mulligan's with vomiting and diarrhea within 24 hours of the event.
"Unofficially, that's what we think it was," Prevost stated. "It looks like a noro-virus outbreak. It's extremely infectious and comes from human contact that contaminates surfaces. It comes on quickly - usually with 24 hours of contact and then it's gone. This is the thing that's been in the news about some cruise ships recently."
Prevost explained that he was able to rule out the food cooked at the party after interviewing many people on the guest list and finding no links in those afflicted and what they ate.

The Erie County Department of Health is rebooting an often-delayed attempt to get its restaurant inspection results online.
County health officials have decided not to lease a system developed by Garrison Enterprises, a North Carolina company the health department has worked with since 2004.
"We couldn't get anything that was reliable," said Andy Glass, county health department director. "We would get something that would work for a couple of months, then it would stop and it would break."
Instead, the health department will use its own informational systems personnel to create software that allows inspectors to electronically file reports from the field using small notebook computers.
The county notified Garrison about its decision earlier this week, Glass said.
Cameron Garrison, the company's chief executive, said that the county decided to sever the relationship for strictly financial reasons.
"Within 48 hours of the invoice being sent, they sent a letter saying they aren't willing to make the deal," Garrison said. "If they want to walk away, that is their prerogative. But we will aggressively pursue money we are owed."
Garrison said the county owes less than $50,000 for services provided -- half the money from their initial agreement.
The county has paid Garrison $36,000 so far, Glass said. The money came from a federal grant.
The county's goal is to put restaurant inspections online by the end of April. Inspection reports for schools, pools and mobile home parks will be placed online by the end of the year, Glass said.
Health inspection reports are currently all done by hand, except for Lake Erie water quality inspection reports. Those are done and sent to the Environmental Protection Agency using Garrison's software.
Once the new system is in place, inspectors will use the notebook computers they have already been trained to use and the system their information systems department will develop.
Restaurant reports will be checked by a supervisor and posted on the Pennsylvania Department of Agriculture's Web site (www.agriculture.state.pa.us) within 24 hours, said Doug Range, director of environmental health for the county Health Department.
"This system will allow us to more closely monitor what facilities are doing," Range said. "Information will be available much more rapidly, both to us and the public."
A licensing agreement with Garrison would have cost the county at least $12,000 a year, Glass said.
"Our IS staff is already paid, so this will just be part of their responsibilities," Glass said.

This week's restaurant inspection scores come to us from the Hardin County Health Department.
Inspector Marian Kellum checks out restaurants all across Hardin County to make sure the owners are following food safety rules.
This week Kellum found very few problems.
#1. Rafael"s Mexican Restaurant 351 South Main Lumberton/Grade=90
We begin with Rafael's Mexican Restaurant in Lumberton. Inspector Kellum found just a couple of problems, the equipment holding plates in the kitchen was dirty and needed to be cleaned and the kitchen sink needed to be cleaned and sanitized. Rafael's still makes a good score with a 90.
#2. Casa Ole 915 Hwy 96 Silsbee/Grade=90
Next Inspector Kellum checked out Casa Ole on Highway 96 in Silsbee. The microwave was dirty .. and the ice machine needed to be cleaned. Despite that Casa Ole in Silsbee also did well with a 90.
#3. Now to Chef Chen 900 Hwy 96 in Silsbee/Grade=93
and finally the inspector checked out Chef Chen on Highway 96 in Silsbee. The restaurant was in need of a thermometer to make sure the cooler was holding food at safe temperatures. Chef Chen scores a nice 93.
The Silsbee Country Club scored an 87. The inspector said the microwave was dirty.
The Valero Diamond Shamrock on South Main in Lumberton earned a 93.
BLUE RIBBON AWARDS FOR PERFECT SCORES FROM THE HARDIN COUNTY HEALTH DEPT.:
J/Rods Processing on Ashcroft Lane in Silsbee made a 100.
And the Pine Arbor Nursing Home on FM 418 West also had a perfect score.

 

OHIO: Health department closes Galion restaurant

GALION -- The Galion Health Department has closed a restaurant because of repeated failed inspections and “recurrent critical violations” since 2005, according to a summary of health inspections.
The department closed M-R Family Restaurant, 741 Portland Way South, on Monday after an administrative hearing deemed it unsafe for patrons. The department also permanently revoked the food operating license of owner Nazif Qorri, a resident of Mansfield.
The last administrative hearing took place Feb. 12 for ongoing and recurrent violations, according to the summary. On April 29, the department served Qorri an emergency three-day license suspension and another emergency suspension Nov. 20 for recurrent violations.
“This has been building for quite some time,” said Stephanie Zmuda, director of environmental health for Galion. “(This is) a history and a pattern for critical violations. They were good about trying to correct things for the short term.”
When reached by a reporter, Qorri declined to comment Tuesday.
Qorri’s restaurant had multiple violations, including dish machine and cooler malfunctions and improper handling of food, according to the summary. She conducts all routine inspections and handles customer complaints for food businesses in Galion. She said there are no other restaurants in the same enforcement process at this time.

UK: Agency announces savings from better regulation

Since 2005 annual savings of £379 million have been delivered to businesses, the public sector and third sector by the Food Standards Agency. Details are in the Agency’s 2008/09 Simplification Report and Plan, published today. The savings include £44 million achieved through reductions in administrative burdens.
The report shows further progress towards the FSA's aim of minimising unnecessary bureaucracy and costs while maintaining and improving public health protection and consumer interests in relation to food and drink. This is the Agency's third report on its rolling simplification programme, and the case studies from stakeholders demonstrate how much real impact the initiatives are having.
The reduction of administrative burdens has been a major focus of the Government's better regulation programme. The Agency has a challenging target to reduce administrative burdens by £136 million by May 2010. More proportionate traceability guidance and the Safer Food Better Business initiative have contributed significantly to savings made so far and will continue to deliver savings over the next two years.
The report also outlines many non-financial benefits passed on to businesses and consumers through improved regulations, with much being done by the Agency to help smaller businesses in particular. The introduction of a Food Safety Management Diary for meat producers has received positive feedback from the industry and flexibilities negotiated by the Agency in the European Union food hygiene legislation, by introducing exemptions for small slaughterhouses, will result in estimated annual savings of up to £200,000. These flexibilities come into force in early 2009.
Other stakeholders also benefit. The plan includes details of the Agency’s work on reducing the burden for the wider public sector and third sector. For example, through the continued development of the GRAIL (Guidance and Regulatory Advice on Import Legislation) database on import legislation for port health authorities and local authorities. Also described are the Agency’s efforts during the European Commission’s review of EU food labelling, to keep hold of exemptions for the third sector.
In the plan, stakeholders are encouraged to submit better evidence where possible to help the Agency deliver its ambitious simplification programme and take forward simplification in Europe. With more than 90% of the UK's food law originating from Brussels, this is essential in order for the Agency to produce meaningful impact assessments to influence the European Commission.
Tim Smith, Chief Executive of the Food Standards Agency, said: 'We’ve made good progress so far in reducing admin burdens by £44 million. We know from experience that when we simplify the rules, it is easier for businesses to comply and consumer protection increases as a result.
'However, with nearly all food legislation originating in Brussels, reducing these burdens can be a lengthy process. While we are grateful for the contributions and interest received from stakeholders on this issue, more effective engagement with all stakeholders is vital if we are to deliver our ambitious simplification programme.'

ANDERSON -- A trio of Anderson girls are in hot water with their fast-food employer for dipping themselves into the sink used to clean dishes.
One of the girls bathing in the sink at the Anderson Kentucky Fried Chicken posted the photos on the Internet and after management learned of them, all three were suspended today, said Cheri, assistant manager at the restaurant. She declined to give her last name.
“The girls are being reprimanded for it,” Cheri said.
She said she learned of the photos, which had been posted publicly on the girl’s MySpace.com social Web site, during the dinner rush today.
Cheri did not give the names of the girls.
The photos, which appeared to have been posted late last month, showed the girls bathing in the deep commercial sink and posing in their underwear and swimwear..
She said no manager was on duty when the photos were likely taken, when the three girls closed the restaurant themselves. In her more than a year at the store, Cheri said she hadn’t had any incidents similar to this.
The photos had been filed under a gallery called “KFC moments.” Captions for the photos included “haha KFC showers!” and “haha we turned on the jets.”
On her MySpace page, the girl lists herself as a 17-year-old worker at the Anderson KFC.
“I’m a KFC worker, they are my best friends and my family,” she said on her site.
Although the pictures were available to the public earlier today, all of the photos on the girl’s site were restricted to private viewers tonight.
In August a 25-year-old Burger King worker in Xenia, Ohio, was fired after a four-minute video of him taking a birthday bath in the restaurant’s sink appeared on MySpace.com and YouTube.com.
The spiky-haired Timothy Tackett became a minor celebrity earning national news attention for the video, in which he appeared to be naked in the sink.

SANTA ANA -- The Orange County Board of Supervisors on Tuesday backed away from a health department recommendation that would have required restaurants to display color-coded placards indicating how they scored on their latest health inspection.
Saying they were concerned that red, green and yellow color codes could hurt restaurant owners, the supervisors instead asked staff to look into how they could make minor changes to the county's existing restaurant inspection placards. They'll take up the issue again next week.
Supervisor Chris Norby said there isn't a public safety need for a new rating system because statistically, Orange County has the same rate of hospitalization for food borne illness – approximately three cases for every 100,000 people – as Los Angeles county.
"If it ain't broke, don't fix it," Norby said, echoing a comment made earlier by California Restaurant Association lobbyist Andrew Casana.
The discussion comes less than a year after an Orange County Register investigation found more than 20,000 major food safety violations in 2007 – ranging from lack of hot water to vermin infestations -- in some of Orange County's 13,173 restaurants, supermarkets, convenience stores and other food venues.
Many restaurants with large numbers of violations operated without the public knowing about the health problems, the Register reported.
The Orange County Grand Jury agreed, saying in a report published in May that the public is "almost universally unaware" of the county's current system for reporting the violations, which includes posted placards that tell customers whether a restaurant passed its latest health inspection, but don't require eateries that were shut down because of health problems to post a notice explaining why.
The Health Care Agency, which oversees restaurant inspections, also makes inspection reports available online (www. www.ocfoodinfo.com).
The color-coded placard system would be less stringent than the Grand Jury's recommendation. OC health inspectors complained that the A-B-C grading system would be costly and could erode trust among restaurant owners and inspectors.
Here's why: A letter-grade program would call for inspectors to assign values for each type of health violation and give each restaurant a grade based on the total score, allowing consumers to weigh the degree of cleanliness at each establishment. But the inspectors said it could create an "adversarial process" for inspectors and business owners who would be more concerned about disputing violations than collaborating to improve health conditions, according to a staff report.
The color-coded placards, they said, would bring less risk of dispute because the inspection criteria would not change. Restaurants would receive a green if they passed; a yellow if the inspector saw major violations that the restaurant was able to correct on the spot but that triggered a mandatory follow-up visit and a red placard if it was shut down.

SYDNEY -- A pizza topped with a band-aid has landed a southern Sydney takeaway store on the NSW government's name and shame list of food safety infringements.
Dominos Pizza on Carter Road in Menai was fined $1100 ($1355) for accidentally serving the bandaid in the pizza in August.
All up 317 businesses now appear on the name and shame list on the Food Authority website, with 502 fines issued.
Primary Industries Ian Macdonald said the list was designed to stop individuals and companies that cut corners on food safety for consumers.
"The fines have been for a range of breaches including dirty premises, allowing pests into food preparation areas and inappropriate temperature control of foods," Mr Macdonald said in a statement.
The website, has had over 1.4 million visitors since it was launched in July.

FRANKLIN, Somerset -- A township woman has sued Taco Bell and its lettuce supplier after she became infected with E.coli after eating tacos two years ago at the fast-food restaurant on Easton Avenue.
Stephanie Kinley, who is seeking a jury trial in the Civil Division of Superior Court, Somerville, is asking for both compensatory and punitive damages from Yum Brands, the owner of Taco Bell, and the chain's lettuce supplier, Ready Pac products.
According to the lawsuit, Kinley bought and ate tacos with lettuce from the township restaurant on Nov. 1, 3, 7, 11, 20, 21 and 25, 2006.
She then became ill with lower abdominal pain, nausea, vomiting and diarrhea. On Nov. 29, 2006, Kinley went to Somerset Medical Center in Somerville.
Kinley then was transferred to Columbia Presbyterian Hospital in New York City the following day. There, according to the suit, she was diagnosed with infectious colitis, most likely caused by the lettuce.
The lawsuit states that the national Center for Disease Control confirmed on Dec. 14, 2006, that there were a total of 78 cases nationwide of people being sickened by the contaminated lettuce.
"Throughout this entire matter, Taco Bell acted openly, responsibly and with the public safety as our primary concern," said Rob Poetsch, a spokesman for Taco Bell. "We're sorry anyone became sick over this incident, and have paid for the medical bills of those who were affected. We've tried to resolve each situation individually, and unfortunately, haven't come to an agreement with this customer."

In 2008, more than 45 million people have flown in and out of Phoenix Sky Harbor Airport – many eating at the dozens of restaurants and bars.
Looking through health inspection reports dating back to 2006, the ABC15 Investigators found Sky Harbor restaurants with major health violations. In some cases, repeatedly failing to follow health code requirements.
Dr. Kelly Reynolds is a microbiologist and public health professor with the University of Arizona in Tucson.
“Cleanliness in a restaurant is very important,” said Reynolds. ““In a high volume fast food situation where you have a lot of people potentially exposed, it's that much more important. We've heard in the news a lot about food born outbreaks and this could be a major source.”
At a Pizza Hut in Terminal 4, a health inspection record points to “rodent droppings found along coved base of walls behind pizza oven”.
Famous Familigia in Terminal 4 received 17 major violations including “deli slicer soiled with food debris” and 12 of 15 employees “without food service worker cards”.
“If an employee doesn't receive that training there could be many potentials for improper behavior that could lead to human disease,” Reynolds said.
And we’re not just talking about food. Maricopa County Environmental Service health inspection reports consistently show black mold in the ice machines and something we found in multiple restaurants’ inspection reports that may be hard to swallow, “filthy soda nozzles”.
In October 2008, the Kokopelli Deli in Terminal 3 was cited after an employee “washed his hands then brushed his teeth with his fingers then went to work with food”. In Terminal 4 at Flo’s Shanghai Cafe, employees were caught “cutting chicken with bare hands”, “portioning peanuts onto chicken bare handed”. Overall, Flo’s Shanghai Kitchen has received 20 major violations and six repeat major violations since 2006, more than any other restaurant at Sky Harbor Airport.
In a statement to ABC15, Flo’s Shanghai Café said:
“Flo’s has 11 years of history now in Phoenix. Our reputation and success have been built on hard work and a sincere desire to deliver the customer with value, quality and supreme service. In addition, we have a close relationship with the health department. Flo’s works directly with them to train, instruct, and help our staff adhere to all Maricopa County Environmental Service Department rules and regulations. If we have ever or will ever violate any of these standards, Flo’s Restaurants has and will take action to correct them.” – Dustin Wallace
“The amount of people that pass through here daily is outrageous,” said a traveler at Sky Harbor Airport. “Yeah, so I think that they should take better care of their facilities.”
HMSHost, the management company representing Pizza Hut, Famous Familigia and Kokopelli Deli, told ABC15:
“We never want to see violations of any kind in any of our establishments, but unfortunately, this can happen and when it does, we take every possible measure to make corrections immediately and prevent it from happening again. As a company operating nationwide in public venues, HMSHost has on-going training with all employees, from those who prepare food all the way to restaurant managers. We also have an ongoing pest control program in place and if there is a problem, we address it immediately. In addition, nationwide we employ an independent health inspection service and as part of the program at Sky Harbor International Airport specifically, we receive “unannounced” inspections throughout the year. This year, the first round of 2008 inspections has taken place and we received high marks. At this time, the final independent inspection for this year is underway and if there are any issues, we will follow up quickly and take action on any findings.”

CALIFORNIA: County finally posts restaurant inspection results

After years of promises, Marin County government has launched online public access to restaurant and food service inspections.
County officials said in 2005 they would post health inspection results online by 2006. But the task was quietly put on the bureaucratic backburner and stayed there until earlier this year when Supervisor Judy Arnold demanded action and called for progress reports that have led to its implementation.
Now, results of inspections are a couple a mouse clicks away at www.co.marin.ca.us/ehs.
The county's system also includes access for diners to report possible violations.
The goal? Public health.
Web-site visitors can find local restaurants by location or name.
They can also learn more about the county inspection process.
What they don't get - but should - are specific details about violations. Readers of the Web listings can find out if there is a "critical" violation, but aren't told exactly what that violation is. They get the code number and the technical citation, but it would be better if it was translated so people who aren't bureaucrats could have a better idea of the problem.
If inspectors found bugs, poor food storage or a dirty kitchen, that's what they should post.
That's what people want to know.
If inspectors determine the violation is "critical," the exact nature of the offenses should not be a mystery to the dining public.
In addition, an up-to-date listing of restaurants that fail to meet inspections' standards would make it much easier for diners.
After all, that's who this effort is for.
At the same time, Marin officials should follow through with plans to honor restaurants that always meet public health standards with an annual "award of excellence." That recognition should be a goal for every restaurant.

Australians might regard themselves as the world's greatest backyard chefs, but the latest research has revealed the average barbecuer could actually be putting themselves and their diners in danger.
Research conducted by the Australian Chicken and Meat Federation (ACMF) showed 60 per cent of people reported witnessing unsafe food hygiene practices at barbeques they had attended.
The findings of the national survey have put a fork through the myth Australians were safety-savvy when it cames to cranking up the barbie, and show Queenslanders are at higher risk of food poisoning due to the steamy climate.
The barbecuer's biggest blunders were undercooking food and re-using plates that had held raw chicken or meat, risking cross-contamination.
One third of people manning the tongs were seen taking chicken off the grill without first checking if it was properly cooked.
``This type of behaviour suggests there is a lack of understanding of why certain food safety practices need to be followed,'' ACMF executive director Andreas Dubs said.
Diners were put at risk of potentially fatal salmonella poisoning if poultry is undercooked, he said.

ALLENTOWN, Pa. -- A Pennsylvania pizzeria insists venison is not on the menu - despite the impression a customer may have gotten when she saw one of the cooks butchering a deer in the shop's kitchen.
The manager of Stromboli Pizza in Allentown says a customer saw one of the restaurant cooks carving up a deer Tuesday. John Okumus says the venison wasn't intended for the store. He says he shot a doe during a hunt and left the carcass in the store's kitchen for pickup by a friend.
Okumus says a customer complained to the city health department after seeing a cook mistakenly butcher the deer.
The department investigated the incident but did not issue a citation.

A restaurant has been fined after serving a salad containing skin and nail from the chef’s finger.
A customer was eating at Pizza Express in West Wickham High Street when she bit into something hard and chewy.
She removed it from her mouth and found something resembling a piece of human skin with part of a nail attached.
DNA testing linked the half-inch piece of skin to the restaurant’s chef, Nicalau Vandley, who had cut his finger while chopping red peppers two days before the salad was served on January 1 this year.
Pizza Express admitted selling food unfit for human consumption and was fined £7,500 at Bromley Magistrates’ Court today (December 3).
How exactly the skin ended up in the salad is not known.
John McDonald, mitigating, said: “One possibility is the skin may have become dislodged when bandaging the cut or on some subsequent occasion.
“It was not serious enough to take time off.
“It was clearly a regrettable incident and unpleasant for the customer.”
Mr McDonald added: “Since the accident the company has co-operated fully with the investigation and carried out a thorough review.
“The company has done its best to put the matter right and ensure this won't happen again.”
Prosecutor Sandra Hines said: “The chef had cut his finger while cutting red peppers and the matter found in the salad had originated from this incident.
“It was concluded that its presence in the food rendered it unfit for human consumption.
“It’s not known how the skin came to be present.
“If the correct procedures had been adhered to, the salad would not have been unfit for human consumption.”
Pizza Express was also ordered to pay costs of £5,108.45.
